Agreement to these terms

By using this website and the F.O.C.U.S. Decision-Maker's Diagnostic Platform, you agree to these terms. If you do not agree, please do not use the platform.

What the platform is

The platform is a clarity instrument grounded in the F.O.C.U.S. Framework. It produces a reflection of how you answered on the day you answered. It is not an audit, not a certification, and not a guarantee of any outcome.

Not professional advice

Your results, install plan, and any guidance on this site are provided for informational and developmental purposes. They are not legal, financial, medical, employment, or procurement advice. You remain responsible for decisions you make in your organization, and you should seek qualified professional advice where the stakes require it.

Intellectual property

The F.O.C.U.S. Framework, its five layers, guiding questions, first actions, artifacts, human-centered commitments, and language are the original intellectual property of Coach Kay. All 20 diagnostic questions are derived from that framework and are owned by Coach Kay.

You may use your own results inside your organization for your own planning. You may not copy, republish, resell, license, train models on, or create derivative programs, assessments, or courses from the framework content or diagnostic questions without written permission from Coach Kay.

Your content

The reflections you write remain yours. You grant us permission to store and process them for the purpose of producing your results and operating the platform, as described in the privacy policy. Do not enter confidential information, personal data about other people, or anything you are not permitted to share.

Acceptable use

When you use the platform, you agree not to do the following.

• Interfere with, probe, or disrupt the platform, its infrastructure, or other users.
• Attempt to gain access to sessions, records, or systems that are not yours.
• Scrape, bulk extract, or automate collection of the framework content or diagnostic questions.
• Use the platform to build a competing assessment or to misrepresent its results as an endorsement.

Availability

We aim to keep the platform available and accurate, and we improve it over time. The platform is provided on an as available basis, and features, questions, and guidance may change. We may suspend or discontinue any part of the platform.

Disclaimers and limitation of liability

To the fullest extent permitted by law, the platform is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose. To the fullest extent permitted by law, Coach Kay will not be liable for indirect, incidental, or consequential damages, or for loss of profits, data, or business opportunity, arising from use of the platform.

Changes to these terms

These terms may be updated. The effective date above will change when they are, and continued use of the platform after that date means you accept the updated terms.
